Legal Question in Wills and Trusts in India
Settlement deed in lieu of a Will
My late maternal grandfather purchased a house out of his own earnings in Chennai but chose to register the same in the name of my late grandmother. They have 2 sons , 2 daughters and a predeceased daughter from whom they have 2 grandchildren. It is now informed by the sons that my grandparents have executed a dettlement deed in the year 1964 in their favour which is also reportedly registered. They are, however refusing to show us a copy of the deed. What is the significance of a sale deed?If it is registered, does it follow that the ownership of the property would also have changed in the Registrar's office?Does the daughters and the surviving children of the predeceased daughter have any share in the property? What is the recourse we have to get the injustice rectified?
