Legal Question in Wills and Trusts in India

sir i have a property in new delhi which i sold out 2004 through registered will which was in my favour.i repurchase that property in 2007 now i start construction on it but my brother's(who was died) wife and his son they stop construction they are saing that they also have share in that property, i dont know, but i think they make a fake will for this property,in my will it was clearly written that there is no share of my borther in this property.my father also make separate will in which they give one land to my brother.my brother aslo sold out that property in 2000. i want to know that should they get stay on behalf of that fake will.my father was died in 1999 and my brother was died in 2002.my all siblings are in my favour also.

by writing at least two wills, one in favour of your brother and one in your favour, your father actually complicated the issue. if you have the copy of these two wills which you admit, it might be little easier for you to prove the fakeness of this third will especially it was not brought until your brother had sold his property and has come up after his death.

But it seems to be long drawn battle. If you have sanctioned plans, then, in my opinion construction may be carried out without prejudice to the rights of the parties.
