Legal Question in Wills and Trusts in India
Thank you very much Sir.Suppose there is no dispute/dispute settled amicably and in case of Executor backing out and the first beneficiary apply for Transfer of residential property in Mumbai as per the Registered Will , how the court will consider such cases ? Kindly clarify whether the court will issue Letter of Probate or Letter of Administration ?

The Court generally issues summons to all the legal heirs to be present and heard prior to issue of the Probate in favour of the beneficiary.
