Legal Question in Wills and Trusts in India

Succession Certificate

I need a Succession Certificate to Transfer Shares which are in the name of my late Father. Will the Court give a General certificate useful anywhere or a Specific one mentioning Company, no. of shares, purpose etc. suitable for one particular asset only?

How much Stamp duty or Court fees I need to pay? Can I only mention Shares with least value to reduce duty?

Thanks

-Anand

Re: Succession Certificate

If there are several properties - movables and immovables - you may need to apply for a succession certificate. All the properties are mentioned in the certificate. It is a lengthy process and you may need to engage a local lawyer.

Re: Succession Certificate

You have to apply for the sucession certificate stating all properties for which you need the same. Fees and duty depends on value of your property.
