Legal Question in Wills and Trusts in India
My suit for permanent injuction against transfer / lease etc of my deceased brother's flat is with the Mumbai city civil court. Another brother is demanding transfer of the flat to himself, on the basis of a bogus and cancelled nomination form. I have obtained an interim injunction. However, the servant of my deceased brother continues to reside there, since his demise. My question is whether she gains any right whatsoever. I will be proceeding to file for a succession certificate and the appointment of a court receiver. Kindly advce.
