Legal Question in Workers Comp in India
Workmen's Compensation Act
my father died in the year 2002 and my mother is getting benefits under the ESI Act. now i want to know whether my mother can file claim petition under the workmen's compensation act. whether is it any bar to claim compensation under the WC Act since she is getting benefits under the ESI Act. please clarify

Yes, your mother & other legal heirs can file compensation under the workmen compensation act as there is no bar if your mother is gettting ESI
