Legal Question in Disability Law in Indiana
if the custodial parent dies and the non-custodial parent is incarcerated who gets custody of the child. There was never a marriage and the parent incarcerated did not have visitation set through Court prior to incarceration, although paternity has been established. Will someone notify the parent incarcerated prior to custodial hearings?

Unless someone steps forward asking for guardianship, DCFS will become involved.
