It can be. If your depression is severe enough that it substantially impairs your ability to perform some major life function (such as thinking or working), then it probably qualifies for protection under the Americans with Disabilities Act. The ADA also prohibits discrimination based on the perception that an employee is disabled or based on an employee's history of disability.
