fired for falling
I was hired with hip problems. I worked for 4 1/2 years with some very little problems. Was promoted to manager position as a temporary assignment to ''see if my legs can handle the added stress.'' 1 1/2 years latter, more small injuries occur. I ask to step down out of the position. Three weeks later I was told I am not safe to ''walk around the parking lot'' and was fired. He would rather let his unemployment insurance ''take a hit'' than his workmans' comp insurance.
Question one: Was it legal for me to record the conversation? The boss who fired me is bad about remembering that he granted vacation time... I went to him asking about one when this happened.
Question two: They've known for all six years of my employment that I have a leg problem; can they fire me with no warning for still having it?

Sounds like a possible violation of the ADA to me. You should immediately file an EEO complaint with your local HR branch alleging violations of your civil rights under that statute.
