Legal Question in Bankruptcy in Indiana
The ex just went bankrupt and has listed me as a creditor
I was recently sued by a credit card company. This was a debt my ex was to pay per our property settlement. The card was used for a busines we tried to start and only in my name. I took him to court for contempt and won, but I had to go ahead and settle with the companies attorney on the card. Now he has filed bankruptcy and listed me. I have been researching for weeks now, but can only find information on how to file a bankruptcy, not what to do if you have been listed as a creditor. I want to try to get this debt non-dischargeable... please help.

Re: The ex just went bankrupt and has listed me as a creditor
I didn't see anything in your post to indicate that you have some grounds for what your ex owes you to be classified as nondischargeable.
Unfortunately, from all the information you provided, he's going to be able to walk away scot free, and you're going to be left holding the bag.
Your options:
1. Pay the debt.
2. Seek bankruptcy protection yourself.
3. Try to dodge the creditor.
In order to contest it, you would have to do what's called an adversary proceeding by the deadlines listed on the notice of bankruptcy that you received. But unless there's more to your situation than what you described, it's not going to do you a lot of good.
Sorry I couldn't give you a rosier picture.
I know this isn't what you wanted to hear, but all people listed as a creditor in a bankruptcy want what's owed to them to be nondischargeable.
If the debt had been classified as spousal maintenance or child support, then it wouldn't have been dischargeable by him...
