Legal Question in Bankruptcy in Indiana
Bankruptcy after Divorce
My divorce was final on 12-15-04. In the decree, I agreed to pay of the mortgage on my house until it was sold. I am no longer able to pay this and have stopped. I am going to file chapter 7. I wanted to know what options I have with regards to the mortgage and my ex-husband.

Re: Bankruptcy after Divorce
It's possible that the obligation to pay the mortgage can be discharged in bankruptcy, but I can't tell for sure without seeing the divorce papers. It may fall into a category where the spouse has to file an objection to discharge. Most bankruptcy attorneys offer a free consultation, so make an appointment with one, and be sure to bring your divorce papers. Good luck.
