Legal Question in Bankruptcy in Indiana
Completed Chapter 13
We recently successfully completed a Chapter 13 plan. We received notification from our trustee stating that it would take several months to get the discharge papers to us. In the meantime, one of the creditors listed in our chapter 13 case (they never filed a claim) has sent us a letter from a collection agency telling us we owe them money. What do we do? They were listed in our plan, but they didn't get a dime because they didn't submit a claim. Can they try to get the money from us now?

No. The debt has been discharged. Contact your attorney and get him a copy of the demand. Have him write a letter enclosing the chedules that has their debt listed. Have it sent certified mail so you can prove they got it. If they continue to hassle you, you can take them in front of the BK Court and seek sanctions for contempt.
