Legal Question in Bankruptcy in Indiana
Expectations during a Chapter 13 plan
I just received court confirmation of our Chapter 13 plan. I want to know what is expected of us during the 3 year Chapter 13 plan. Everything has been sort of vague....just keep up with your payments is really all we've been told. Is that all we need to do? If my husband receives a bonus at work in the next few years, is it our responsibility to let the Trustee know? Our attorney is not very accessible and when I do reach him he's rude and not very informative. Should I change lawyers or at this point do I let it go? I don't want our plan to get dismissed based on being uninformed.

As far as future duties, Mr. Bator is correct, mainly you just need to make the payments. However, you do have the duty to keep the Trustee and your attorney informed of any changes. Changes in income, like the bonus you mentioned, are very important. Anything that affects your ability to pay the Trustee must be given to your attorney. Also, if you desire to finance anyting or incur debt or sell anything, you need to make your attorney aware of this as well. So make your payments and keep your Trustee and attorney informed of changes.

Unfortunately you already ahve an attorney so you need to talk to him/her. I am sorry you have been treated rudely. Just make you plan payments on time and keep up with your other bills and everything should work out fine. Good luck!
