Legal Question in Bankruptcy in Indiana
filing bankruptcy
My husband has a tax bill over 3 years old of $40,000 and
high medical bills. Can he file bankruptcy in his name only and not bring my
assets into it. I own our home and 4 acreas in my name only. He tried to file a comprimise but they wanted to bring my assets into it.

Ooh, it depends and it's hard to tell from your facts. Were these returns jointly signed by both of you? Also, although your property doesn't come into play in a chapter 7, your income MAY be an issue. Finally, you have to be very careful when trying to discharge taxes. Request a record of assessment from the IRS and seek a competent bankruptcy attorney. This is not one I recommend going alone on.
