Legal Question in Bankruptcy in Indiana
Habitual bankruptcy filer
I am dealing with a person who has filed bankruptcy on three separate occasions. He has not paid his real estate taxes in years, nor can we sell his hosue at tax sale. Is there anything I can do to collect the back taxes? I have filed proofs of claims on his previous Chapter 13 which converted to a chapter 7. His case was discharged in September of 2000 and as of November 7, 2000 he has filed a new chapter 13 bankruptcy.

You can be assured that the current Chapter 13 cannot be converted to a chapter 7 again. Unless you have a priority claim or a secured claim, your claim for taxes might have been discharged. You should consult the U.S. Trustee's office to be assured your rights as a creditor are being protected.
