Even though the courrt didn't rule on it, intentional torts such as battery are generally excluded from a chapter 7 bankruptcy discharge. Since the court didn't decide it, you may have to re-litigate it in a bankruptcy. Now, you could file a chapter 13 bankruptcy as there is no provision for a intentional tort debt. You may be able to just pay him back pennies on the dollar in a ch 13. You need to meet with a bankruptcy attorney to discuss more fully.
