Which is better having a job or not?
I would like to know if filing while you are unemployed is better than filing while you have a job? I also have a car that is co-owned, how do I put that in my bankruptcy?

The answer to your question depends upon your ability to pay the necessary attorney fees and filing fees to the Court. Also, if your financial situation improves significantly within 6 months from your filing (say you filed wile unemployed and magically have a great paying job within 6 months), the US Trustee can ask that your bankruptcy be reopened for further proceedings. A co-owned vehicle is listed as a secured debt, listed as an asset and the co-owner and/or co-debtor is listed elsewhere. If you do not reaffirm such an obligtion, the co-owner or co-debtor may be sought out by the creditor for payment.
