Medical Problems may cause force bankruptcy

In the last year and 9 months I have been diagnosed with Chrones and Fibermialgia and I'm not able to work. I have been trying to do my job but it's not going too well. I'm

planning to file for disability and I may have to file for bankruptcy and I don't want to loose my house. My wife works but her income isn't enough to make are morgage and It may take a long time to establish a disability claim. I take med's for both coditions but they have several side affects, dizzyness and dry mouth and I miss work alot because of pain. Please let me know if I could loose my home. The pay off of the property is 79,000 and it appraies at 115,000 Thank you very much for your answers Mr.Sick

You should confer with a local attorney who is experienced in bankruptcy matters, because there are many more facts needed to evaluate your situation. Ask your county bar association for a referral. As to your question, if you are not able to make your mortgage payments, then you will not be able to keep your house, even if you do file bankruptcy. However, if by eliminating or greatly reducing your other debts you are able to make your mortgage payments, then you will be able to keep the house. If your equity exceeds the combined exemptions for you and your wife, then you will need to file a chapter 13; otherwise you could file a chapter 7. I also suggest you confer with your local housing authority to see if there is any grant assistance available. Good luck.
