Legal Question in Bankruptcy in Indiana
Poor Health
I have recently had unexpected medical bills. I previously purchased a 1500.00 vaccuum. I can not afford payments due starting in July 03. I need to get rid of this debt somehow. I can not burden my cosigner. I would have had no problem making payments but since my medical condition, I have trouble working due to a damaged heart. You should first look at the contract covering the purchase of the appliance to see if there is an out. I doubt if there is. I assume the 72 hour cooling off period has now also expired, which also provides no relief. Unless your specific state has extra consumer protection laws, you are pretty much stuck with your purchase unless it is defective in some way.
Because it is a financing contract, I assume that it will be sold to a financing company, and they will take over the servicing and collection of the payments due on the cleaner. If you have already received notification from them, I would call them up and explain the problem and maybe they will hold off on trying to collect. At the same time, I would call the company that sold you the cleaner and try to get them to take it back. I have to say, I am not too optimistic about them taking the cleaner back and foregoing trying to collect on the balance due.
