Legal Question in Bankruptcy in Indiana
Reafirmation forms
Bankruptcy was supposed to be reaffirmed to exclude car and was not. Bankruptcy has now been closed and archived. What can be done now to show finance company that car is not part of bankruptcy?

The car loan had to be listed but you should have entered into a reaffirmation agreement with the finanace company before the case was closed. The Court will not allow the case to be reopened to file a belated reaffirmation. The debt has been discharged and you have no legal obligation to pay the debt. Of course the finance company has the right to repossess the car unless you get them to agreee to continue to accept payments
