Rights of spouse who is not filing

If I am going to file Chapter 7 because I have a large debt in my name only, but my husband is not filing, is he able to continue to pay our credit cards on time that are in both of our names?

Are Roth IRA's exempt assets?

Yes you husband can keep paying your joint credit cards

if you file a Chapter 7 bankruptcy. In fact, if he doesn't,

the credit card issuer will likely take collection action

against him.

Retirement accounts are exempt assets. Check Indiana

Code Section 34-2-28-1(a)(6) for more details.
