Legal Question in Business Law in Indiana
My artist and I [writer] signed a contract to be publish by a new Company in September 2009. We where told the first magazine would be out in October 2009. It is now Jan. 2010 and the magazine has not been out. I have been told time and time over that it would be out. I am also helping with their website and have been told that they would get me stuff to get it up. But besides that the President keeps telling me that either his computer is down, the distributor sent the wrong items and so many other excuses. Seeing as it has been about 5 months now sense we have signed the contract I need to know what to do. We have sent him two issues of our comic as well. It is also effecting my health. I also don't have money to do much. I was told I would get a certain amount for each magazine sold. And I have yet to see any money. I need to get out of this contract along with my artist. And reimbursed for what we could have made if they would have released it in Oct. 2009. Please Help Us.

Your answer is probably contained within the contract itself. It should contain breach/default/termination provisions. Review the contract and/or have an attorney take a look at it. The contract sets forth both parties' rights and obligations.
