Legal Question in Business Law in Indiana

Business Name vs Domain Name

A local retail business, call them A, (in business for 27 years) decided to look at expanding to the internet.

A discovered that another business, call them B, selling the same product in the same city registered A as a domain name within the last 4 months.

Company A does not have a registered Trademark. They want to get the domain name. What kind of rights does A have to their name?

Re: Business Name vs Domain Name

Do a Google search for - tradename internet squatters - and you will come up with some useful information. Company A - if it has been in business for 27 years - probably has a defensible trade name, and can probably force the pirates of Company B to withdraw. But Company A should spend the money to have a real attorney make the demand, so that the penalties for Company B's transgression can be exquisitely described.
