Legal Question in Business Law in Indiana
I have a car issue with a buy here pay here place in Indiana. I started making payments on the car (an 07 pt cruiser) March of 2009-had 41,000 miles on it. I have recently started having major issues with the car(transmission going out,cv boot broken,transaxle module faulty,vaccum leak.) The issues to be fixed would cost well over 3k. I have taken good care of the vehicle but have put about 17,000 miles on it. The dealership says that the car is out of warranty and they will not fix anything all the while I am paying them 350.00 a month for the car. Is there anything I can do without getting sued for the total amount? I have been thinking about returning the car to the lot if they will not fix the issues. Would it make a difference if I found out that the car was totaled before I bought it and they did not disclose that information to me? Thank you for your help.

If the car is out of warranty, it is out of warranty. There is little that you can do about it.
THe second aspect of your question would depend on whether you bought the car "as is" and specifically asked about the car's history and was lied to.
