Legal Question in Business Law in Indiana

Company Name Pirated

I,ve been in buisness for over twenty years in the same town. I now have an employee of a long time competitor opening his own buisness with the name of his buisness and mine being different by only one word. I feel this was clearly not an accident because my customers are mixing us up and I feel this was their intention from the start. Do I have any legal recourse in this sitiuation? Thanks so much for any advice you can offer.

There are too few facts given to give a really good answer. I doubt you have registered your business name as a trademark/servicemark. So that leaves out the easy remedies. You really need to set down with a lawyer so that the details can be sorted out.

Being a self employed sole proprietor I can understand your concern! Based on the facts presented, you definately have a cause of action. You should hire an attorney ASAP to send a cease and desist letter.

Good luck!
