Your success in suing them will depend on (1) whether you'll have to sue this party in India or if you can sue them in the US and (2) the exact terms of the agreement + what was completed/not completed.

You need to visit a lawyer (a civil litigator) in your town for a consultation (most litigators will meet with you for little or no cost) to evaluate your situation to see if you even have a case. The best way to find an attorney is to ask your family, friends, and colleagues for a referral. After that, your best bet is to contact a local bar association for referrals.

Actually, the real issue isn't where you can sue them, but can you collect from them. Also, the internet is also a very good source for finding a lawyer to represent you.

As a franchise attorney, I can tell you this. Next time, use an attorney with international experience before you send $4k to a foreign country. Unless they have assets here in the U.S., even if you get a judgment against them (which will cost you a lot more than the $4k you are chasing), you won't be able to collect. The only good news is you will probably have a bad business write-off, assuming this happened as part of an existing business. Talk to your CPA about this. Next time, consult with a good business or franchise attorney in your area for specific advice.
