Legal Question in Business Law in Indiana
A customer at my bar put soap in orange juice that was intended for a specific customer he did not drink the orange juice but found out about it. I didnt know it had been done till after someone else tasted the orange juice and I was told. Is there anything that can be done to me legally?
1 Answer from Attorneys
The customer who put the soap into the orange juice could be held liable on several causes of action but, since you had no awareness of the act, you should not be held liable. The customer's action constitutes a third-party criminal act. Generally, a landowner does not have a duty to protect people on his or her property from criminal acts by third persons, absent a special relationship. A commercial property owner is not an insurer of the safety of the customers entering the space, and has no duty to protect against unforeseeable criminal actions.
