Legal Question in Business Law in Indiana
Employer doesn't turn in retirement contributions.
My employer started a simple IRA and began deducting my retirement contributions from my paycheck on Jan. 1, 2004. My employer is supposed to be matching my contributioins up to a certain percentage. As of March 10, 2004 my financial investor has not received any of my contributions or any matching contributions. Before I confront my employer are there any legal issues with what he is doing?

Your employer could be in violation of the federal ERISA law if the agreement concerning the IRA contribution is not fulfilled. Be sure the employer is obliged to make current, rather than quarterly, payments. Then make your inquiry. ERISA remedies are limited to your attorney fees and the benefits which should have been provided. Good luck.
