Since an employer can keep their employees from keeping their cell phones in their pocket, is this still true if it is not states in the company policies? And...if so, or not, why? What gives them this power? Statutes etc?

You have now changed your fact situation. My previous answer was in reference to a vibrating phone, not just possessing a phone.
