Legal Question in Business Law in Indiana
Friday night or early Saturday a local Nursery delivered mulch to my home and returned on Tuesday to say they had delivered it to the wrong address. Unfortunately our Gardener had already put the mulch down on Monday. I too had ordered mulch so there was no reason for me to question the arrival of the mulch over the weekend. Now I am being sued by the local Nursery because I refused to pay $6.50 a bag (I offered $2.50 a bag which is what I payed for my mulch). Am I even liable for this local Nursery's delivery mistake?

Good arguments can be made that you owe nothing or
you owe fair market price.
