Legal Question in Business Law in Indiana
We hired a lawyer on a fixed fee contract $15,000.00 to represent our son on criminal charges, with a fee due 60 days of $5,000.00 if it went to trial. We paid the $15,000.00 and as it got closer to looking like we were going to trial we paid the $5,000.00. A last minute plea deal ended with no trial The lawyer will not refund the $5.000.00. Originally when questioned very early on in the case she stated it would be refunded. The fixed fee agreement, states as much, however now she won't give it back, what recourse? We have this in a contract with her stating as much.

1. You cn sue for the $5000.
2. You can report her to the disciplinary commission .
