Legal Question in Business Law in Indiana

Home Repair

I had a large window installed in June of 2006. The installers could not use the old trim and had to replace it with new trim. Since I know nothing about painting or staining of wood, the installers applied the new trim to the window untreated. They had caulked the inside surface of the window with silicone, some of which is now adhered to the adjacent trim. I have since hired a painter to stain the trim for me; he says that the caulking was improperly applied and so affects the trim so that no stain or paint will adhere to it. He says the trim needs to be removed along with any excess silicone, and new trim will need to be applied, and stained prior to placing it back around the window. The painter wants the window installers to take care of this; it is their responsibility. I've dug up a document printed by the window company; a ''Completion Certificate'' which I'd signed after they installed the window which states that I acknowledge that they have furnished all goods, services and work and have fully performed the requested work and that there are no goods or services yet to be furnished and no further work yet to be done and that all has been done to my satisfaction. Do I have any recourse with the window people?

Re: Home Repair

Yes, send them a certified letter staing what you stated in the posting and ask them to correct their work.

If they wont, and if they itemized their cost, sue for the amount attirbuted toi the faulty work. If they did not, then get a written estimate and sue for the amount of the estimate.
