Is it legeal to force an employee to utilize PTO (paid time off) hours they have accrued, yet opt not to use them? Company policy states you must maintain 64 hours of work to keep benefits, but does not state you MUST use PTO thereafter; however, the supervisor says you have to use PTO time if you have it and can not ''Bank'' it.

Is there a collective bargaining agreement that governs this? If not, is there a written policy or procedures manual that discusses the PTO. Also, is this policy being enforced in a discriminatory way, or across the board. It does not sound like you have a case, without taking these considerations into effect.

I am not aware of any problem with this. From your description that is basically the agreement offered by your employer and accepted by continuing to be employed.

So long as the employer is not trying to pull any shenanigans to evade the provisions of the Wage and Hour law, then the PTO will be governed by the employer's policies. Read the employee manual, and if the PTO requirements are provided for there, and if the supervisor is correctly interpreting the policy, then it is "legal."
