Relocation Expenses

I signed a contract which read that if I terminate my employment before 1 year from ''physically relocating to my place of work'' I would have to pay them back in full. I signed the contract on 10/18/2005 which was my first day of work. The company was putting me in a temporary resident until I found a home in Columbus IN. The apartment they put me in was in Columbus so by my definition I was ''physically relocated''. 2 months later I bought my house and I resigned on 10/26/06. By all rights I was employeed and lived in Columbus Indiana over a year and should have fullfilled my obligation. They are interpretting ''physically relocated'' as in my permannent place of residence but nowhere in the contract does it define what the term ''physically relocated to my place of work'' means. Also, there is no date on the contract that clearly specifies a date the contract would be considered fullfilled. All other documents given during the offer stipulated ''from the date of hire''. I think I have a strong case to fight this since it was never explained and is not clear in the contract.

They have the burden of proof. I suggest that you do some case law research to determine whether the INdiana courts have interpreted "physically relocated".
