In India, business can be carried on by different types of legal entities like (a) Proporietorship concern (b) partnership firm(c) company incorporated under Companies Act, 1956. To incorporate a private limited company under the provisions of the Companies Act, 1956, minimum critaria is (1) there should be at least two members and (2) minimum capital of Rs.1 Lakhs. The process of incorporation of a company starts from filing an application for availability of proposed name and ends with issuance of the Certificate of incorporation.

There is no specific crieteria for starting a business under HUF. You have to decide whether you would like to start the same as a proprietorship, partnership or company. Once decided you may have to obtain mandatory registration under the local and nationals laws
