Legal Question in Business Law in Indiana
I am starting up a concession business selling home-made ice cream, using a John Deere hit and miss engine. Can I place a photo of the John Deere engine on the side of my concession trailer without getting in trouble with John Deere (enfringing upon any John Deere licensing or trademarks)?
1 Answer from Attorneys
As a Franchise Attorney I can say this. You can definitely get sued by John Deere for infringing on it's registered trademark if your proposed photo displays anything the company has registered, like its logo, etc. The better route is contact them and ask for permission. Consult with a good business or franchise attorney in your area for specific advice.
