Can I sue my mortgage company? My mortgage company has lost part of my mortgage payment in Jan. and the entire mortgage payment for Feb. My bank has faxed copies of the payments coming out of the account 3xs, and they have lost the faxes, although they have sent conformation faxes back. They have now sent a foreclosure mail out to my residence, and informed us they have not received any of the payments. When talking to their supervisors, they are unable to fix the problem, unwilling to fix the problem, and attempt to collect more money.

The loss of payments would be a defense in any foreclosure action and you probably have at least one counterclaim if not more. You really need to see an attorney to handle this.
