Legal Question in Civil Rights Law in Indiana
protection of our rights
The eeoc found my daughters employer guilty of sexual discrimination and issued a right to sue [because he wouldn't pay all the bills].it is now going on three years later,we are into our lawyer for $33,000 ,they postpone the settlement conferences.now he is telling our lawyer that he will declare bankruptcy if we ask for to much money.my daughter cries a lot ,she almost lost her baby because of the stress.my question is can we do anything to stop him from filing bankrupcy[he makes 3-5 million a year, our claim is under $100,000]if he had just paid in the beginnig the cost would have been around $18,000.thank you

Re: protection of our rights
Unfortunately there is nothing you can do to prevent someone from filing bankruptcy. Given the assets you describe, however, it may well be an idle threat, as he would lose control of everything to a trustee should he file.
The threat is often made; it is not often followed-through with.
Bottom line you really have no choice but ignore the threat and proceed to settle on the most advantageous basis you can.
