Legal Question in Constitutional Law in Indiana
maranda rights
i'm being charged with intimidation to a law officer. I need to know if it's right for them to charge me with this even though i was also arrested for minor in possesion of alcohol and i blew way above the legal limit. Also i was never once read my rights to me or i never signed a waver of rights.

Re: maranda rights
Minor in possession and intoxication are separate charges, as is threatening an officer. You can be legally charged with more than one offense from a single encounter with law enforcement.
Miranda warnings are required only when a suspect is in custody and is going to be questioned and a statement taken. If there is no custodial interrogation, Miranda advice is not required.
