Legal Question in Construction Law in Indiana

land

my husband and i purchased a home in a housing addition. we purchased the biggest and most expensive lot. they told us it was .5 acres. after they laid our slab we went and measured our land. from one corner of our slab straight back was supposed to measure 99ft. it actually measured 63ft. 36ft was a huge ditch they told us nothing about. the ditch runs all the way across our land. it measures 36ftX195ft. for a total of 7020ft2 which equals .161acres of ditch. so instead of getting a .5 acre like we thought we actually got .339acres. i dont see how they can get away with selling us land we can not use. plus they never even told us about the ditch or we would have purchased a less expensive lot.l we are fine with the size of usable land but i think we should be reimbersed some of the money we paid for the land. please tell me what you think.

Depending on the circumstances and what they told you (and how), this MAY constitute misrepresentation or fraud. On the other hand, it is much more likely that you were legally responsible for checking out the property that you purchased ahead of time. I would need to know more of these details to be able to advise you.
