Legal Question in Consumer Law in Indiana

auto repair

My daughter in Missouri is having a problem with the owner of an independant repair shop. He has done a lot of work on our family's cars, but we have been suspicious of the quality of his work and his high charges. She took her car to another repair shop and was told that a recent repair was done with the wrong part, along with other questionable findings. For verification, she took it to the local dealership. The questionable quality of recent work was verified. She spoke with the owner/mechanic about the problem and she was told he would re-imburse her for the repairs she needed now, but she would need to return the part that was replaced. The next day he called her and cancelled the deal, and the car was in the second shop getting the work done. Needless to say, she is very upset. ALOT of money has been spent at the shop in question over the past years, yet he is being very difficult and rude--even cursing at her step father who politely spoke to him in her behalf. She feels as if she has been takin advantage of, due to her limited knowledge of auto repairs. Does she have any recourse? She has written statements from the shops who looked at the car agreeing wrong parts were used. What can be done?

Re: auto repair

She would need to be able to produce if possible copies of all the work done on the car by the repain shop in question. She would then need the statement and testimony from the dealer who fixed her vehicle properly. If the amount is under $6000.00 she can take them to a local small claims court. If not, she could file a motion with the court for refund on the repairs. She may get better satisfaction if she lives near marion county by having someone like call 6 for help to do an under cover story.
