Legal Question in Consumer Law in Indiana

Hello, I purchased a vehicle (BMW X5) recently (less than 30 days ago) from a car dealership out of state. It was my first vehicle purchase out of state and the dealership is a reputable dealership (or so I thought). We had the dealership inspect the vehicle for us and they said the only issue was a window that was not working properly and they would have their service department repair it before we had it shipped. We had the vehicle for several days (approx 5) before we even thought to check the window and it still doesn't appear to be working correctly. We called them and asked if their local sister-dealership could repair it (It's a Penske dealership and we have one in our city as well). They said the vehicle was sold "as is" and they will not invest the time or money to repair it. It is true, we purchased the vehicle "as is" and I signed paperwork stating that, but the agreement was the window would be repaired before purchase (of course we don't have that in writing, but they certainly admit they attempted to repair it before it was shipped).

What can we do? It's a $390 repair. Is it worth pursuing and if so, what would our next step be?

File a small claims case or give up on your claim.
