Legal Question in Consumer Law in Indiana

While getting new tires on our car, the mechanic let the car roll off the rack and we incurred some considerable damage to the undercarriage. They have covered repair costs & a rental auto. We rented the auto just before closing time and drove the car directly home. The next AM when we went to use it, we saw a dent which we were afraid hadn't been adequately documented on the rental agmt. We immediately called the rental co. and went to their office to explain our concern. They filed a "change of conditioon" report. We subsequently got a letter from their damage recovery unit asking us to report this to our ins. co. and credit card co. We still have the car in our possession but may have to return it in a couple hours as our car is now repaired. What should we do? Would the tire company have any liability in this rental car fiasco?

The tire company has no liability concerning the damage to the car. I am afraid to say that if you signed off on the rental and the customary inspection before the rental was driven off, you have a problem. Perhaps, the car rental was in an area with poor lighting so that you could not determine that there was prerental damage.
