Legal Question in Credit and Debt Law in Indiana

Debt Collection After Death

At the time of her death, my mother-in-law had lived in my home for several years. She did not own property, did not own a vehicle and had no money other than her social security check. She handled her own financial affairs. She left no estate of any kind. Since her death we are getting repeated calls trying to collect payment for a credit card balance she apparently owed. They have been given the above information several times and were provided a copy of her death certificate. We have asked them not to call again, but they continue to do so. I do not believe I am responsible for paying this debt and feel quite harrassed by the repeated attempts to collect this debt from me. Short of changing our phone number, what can be done to stop these calls?

Re: Debt Collection After Death

First, no one who was not a co-signer is responsible for a decedent's debts. You have no legal liability to pay. Second, the continued calling of these debt collectors is harrassment. You can ask your phone company to put a block on your phone for these numbers. And you can sue them for annoying you. You will need to have names and contact information -- mainly a good address. Good luck.
