Can they do that??

I had a dog pass away in October 2002, and when this happened I gave the Vet my credit card number over the phone for the charges to be charged to me. I thought everything was taken care of until about a year later they called asking for payment. I advised that I had paid and I told them I thought they had the wrong persons information. I did not hear from them nor get a bill from them so I thought all was okay. Then last May 2005 I get a letter from a collection agency saying that I owe them money still. I had to get a copy of my credit card statement showing charges in the amount of 40.00 from the Vet. I sent this to the collection agency and they advised me my bill was for 137.00 and I still owed 97.00. Now this was not my error, but the book keeper at the Vet. Can they come back three and a half years later and threaten to take me to court when it is their error??

Their error is your defense against them in court, assuming they cannot prove the actual value of their services rendered.
