Legal Question in Credit and Debt Law in Indiana
My name is Frank Anderson and my problem is with my mortgage company HSBC. Last april of 2010 I underwent an emergency Triple bypass surgery. Knowing I would be off work for several months and drawing only 60% disability pay I had to drastically cut my family spending and when every thing was cut to the bone and that wasnt enough I thought to call HSBC to see if they could help me. They told me they had a Hardship Department and that dept said I may qualify for a mortgage modification. After making the 2 trial payments at a lesser amount then I was approved for a 6 month modification at a lower rate. The problem was the acceptance letter I recieved had the lower rate but my old payent on it. I immediately called and was told it was an error and I would pay the lower payment that I did during the trial period.so I did so Usually in bi-weekly amounts..This is how I've paid my mortgage for some time now. I kept getting deliquency letters or harrassing phone calls saying I,m behind in my mortgage when I knew I was not.I would again call and was told they would get it straightened out. Still the letters kept coming and it has snowballed to certified leters and a forclosure threats. One day I'm told my loan has been restructured as a favor to me and the next day I,m told I,m going to be forclosed on if I don,t immediately pay X amount of dollars. There has been many more than a dozen if not dozens of calls each ending in the promise that it would be straightened out from very polite people( with the exception of a couple.) This is the Readers Digest version. Do I have any options. I regret the day I ever asked for help from them, the stress is unbearable...HELP ME PLEASE!

Mr. Anderson- just so you know, there is hope! Please call our office in the morning or even my paralegal and she will assist you with this matter. I will tell you, having a modification filed by yourself and having representation makes a huge difference. If all else fails, there are other options available to you as well. As a last resort and depending on your other finances, we can file a chapter 13 for you. This would take care of any medical bills you have outstanding, and unsecured debt and you can pay back the arrearage on the mortgage over a period of time.
