Joint Debts

I would like to know if there is a way to legally separate my wife's debts from mine. Twice, I have paid off

her credit card debt after she has charged it to its limit. I tell her not to use it except for emergencies and

she tells me she doesn't, but I find credit card receipts and overdue bills, telling me that she is using her card to buy nonessential things and also to pay some of her other bills. Since she is an adult, I don't see

how I can make her stop spending, but when she starts getting deep into debt, I will be expected to bail

her out since I am her spouse, and some of her late payments are already showing up on credit reports.

Is there some kind of document that I can have her sign to legally separate me from her debts or can I

legally take her credit cards and cut them up.

It will be difficult to do what you ask without your wifes cooperation-you could contact each creditor and make arrangements to pay off the accounts and request that they be closed since your name is on the account. However, if your wife opens new accounts without your knowledge and signs your name, youve got trouble. I suggest you consult an experienced creditors rights atty (someone who represents credit card companies and bring in copies of the bills-bring your wife! Good luck!
