Legal Question in Credit and Debt Law in Indiana

Motion to vacate judgement

I've been fighting this collection firm in court for approximately a year. I thought that my court date from March 23, but it was March 22. The Plaintiff won by default and their summary judgement was granted. How can I fight this?

Summary judgment makes it sound like this was not a small claims case. If it was, be a bit more careful about your terms. A default in small claims can be set aside within one year if there is a good defense. No such lucky really with a case on the regular docket. You need to take this to an attorney as I feel there may be facts which help you that remain unsaid by you.
