Legal Question in Credit and Debt Law in Indiana

Reversing a levy by claiming an exemption

In 2 days will appear for court hearing for wage garnishment. Do not dispute amount, but am concerned about the 25% disposable earnings to be taken from paycheck, due to recent decrease in income related to medical problem. How can I claim an exemption to reverse the levy or how can I show the court I will be unable to meet current living expenses if levied the entire 25%? I did make a verbal agreement with collector 6wks ago and have made on time payments of the verbally agreed amount. Collector assured me they would drop the wage garnishment, but am not surprised to find the hearing is still scheduled.. Thank you for your time!

Re: Reversing a levy by claiming an exemption

If you make less than the statutory amount per week, they cannot garnish your wages. I believe it is something around $150 per week
