Legal Question in Credit and Debt Law in Indiana

Statute of Limitations to file for collections

I paid a doctors bill at the time services were rendered 6/20/00. Now they are filing with a collections agency 6/25/04 saying I never paid. Is there a time limit at which they can no longer ask for payment? I have never received a bill because I paid the bill at the initial visit. What are my options?

Re: Statute of Limitations to file for collections

The first thing I would do is call the billing department of your doctors office and find out what is going on. It could be as simple as a clerical error on their part.

I would also send a certified letter to the collection agency disputing the debt and asking for proof of the debt.

If you never signed anything at your doctors office then the statute of limitations is 5 years but if you did sign something that says you are responsible for the debt if your insurance does not pay then its 10 years.
